Right of Withdrawal and Product Returns

In cases where the User purchases products on or through the Website, they are entitled to a number of rights, as listed and described below:

Right of Withdrawal

The User, as a consumer, is entitled to withdraw from their purchase on the Website within 14 calendar days, without needing to provide any justification.

This withdrawal period will expire 14 calendar days from the date on which the User or a third party authorized by the User (other than the carrier) takes physical possession of the goods purchased on the PetyChery - Pet replica Website. If the items in the order are delivered separately, the period expires 14 days after the User or authorized third party takes possession of the last of those goods. In the case of a service contract, the withdrawal period is 14 days from the date the contract was concluded.

To exercise this right, the User must notify PetyChery - Pet replica of their decision to withdraw. This can be done using the contact options provided on the Website.

Regardless of the communication method used, the User must clearly and unequivocally express their intention to withdraw from the purchase contract. The User may (but is not obliged to) use the model withdrawal form provided by PetyChery - Pet replica as an annex to these Conditions.

To meet the withdrawal deadline, it is sufficient that the communication expressing the intention to withdraw is sent before the 14-day period has expired.

In case of withdrawal, PetyChery - Pet replica will refund all payments received, including shipping costs (except for any additional charges chosen by the User for a delivery method other than the standard least expensive option offered), without undue delay, and no later than 14 calendar days from the date PetyChery - Pet replica is informed of the User’s decision to withdraw.

The refund will be made using the same payment method used by the User for the initial transaction. This refund will not incur any cost to the User. However, PetyChery - Pet replica may withhold the refund until the returned products are received, or until the User provides proof of return — whichever comes first.

Returns must be made without undue delay, and in any event, no later than 14 calendar days from the date PetyChery - Pet replica was notified of the User's decision to withdraw.

The User acknowledges that they will bear the direct cost of returning the goods (shipping, delivery), and will be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The User is also aware that exceptions to the right of withdrawal exist, as outlined in Article 103 of Royal Legislative Decree 1/2007, of November 16. These include, but are not limited to:

  • Personalized products

  • Goods liable to deteriorate or expire rapidly

  • CDs/DVDs with music or video unsealed by the User

  • Products sealed for health or hygiene reasons that have been unsealed after delivery

  • Digital content not supplied on a tangible medium

Likewise, for services purchased on the Website, the right of withdrawal does not apply once the service has been fully performed, or has begun with the express consent of the User and their acknowledgment that they lose the right to withdraw once the contract has been fully executed by PetyChery - Pet replica.

No refunds will be issued if the product has been used beyond what is necessary to verify its nature, or if the items are not in the same condition as when delivered or have been damaged after delivery.

All returned items must include their original packaging, manuals, and documentation, as well as a copy of the purchase invoice.

Return of Defective Products or Delivery Errors

This applies when the User believes that the delivered product does not conform to the order or contract. The User must contact PetyChery - Pet replica immediately and report the issue (defect/error) using the same contact methods listed above.

The User will then be instructed on how to proceed with the return. Once returned, the items will be inspected, and the User will be notified within a reasonable timeframe whether a refund or replacement is warranted.

The refund or replacement will be carried out as soon as possible, and in any case, within 14 days from the date an email is sent to the User confirming the refund or replacement.

For defective products, the full amount paid, including delivery costs and any return shipping costs incurred by the User, will be refunded. Refunds will be made via the same payment method originally used.

The User will always retain the rights granted under current consumer protection laws.

Guarantees

The User, as a consumer, is entitled to legal guarantees on all products purchased via this Website. PetyChery - Pet replica is liable for any lack of conformity that becomes apparent within three years of delivery.

Products are deemed in conformity if they:

  • Match the description provided on the Website

  • Are suitable for normal use of similar goods

  • Possess the usual quality and performance expected of such products

If this is not the case, the User must proceed as outlined in the section “Return of Defective Products or Delivery Errors.”

Some products may have non-uniform characteristics due to the nature of the materials used — these are considered normal and not defects.

If the User purchases a product on the Website from a third-party brand or manufacturer, and believes the product is defective, they may also contact the brand or manufacturer directly to exercise their legal warranty rights within three years of delivery. To do this, the User must retain all warranty-related information.
